DUI Arrest in Orlando: What Happens Next

A DUI arrest in Orlando follows a set path: booking at the Orange County jail, a mandatory hold, a bond that's usually on the schedule, and a 10-day deadline that catches a lot of people off guard. Here is each step, with the numbers from Florida law and the court's bond schedule.

    Where They Are Taken

Arrests in Orange County are booked at the Orange County jail’s Booking & Release Center, 3855 S. John Young Parkway in Orlando. Booking, first appearance and release all happen in that building. The jail’s phone number is (407) 836-3400.

You can look them up with the Orange County inmate search, which updates every 30 minutes and shows the charges and the bond once it’s set.

The DUI Hold: Why They Can’t Leave Right Away

Florida law does not let a person arrested for DUI be released until one of three things is true: they are no longer under the influence to the point that their normal faculties are impaired, their blood or breath alcohol level is below 0.05, or 8 hours have passed since the arrest (Fla. Stat. 316.193(9)).

So even with the bond posted, a DUI arrest can mean a wait until that hold clears. On top of that, Orange County Corrections says the bond process itself can take up to 12 hours.

How Much Is Bail for a DUI in Orlando?

Most misdemeanor DUIs have a set amount on the Ninth Judicial Circuit’s bond schedule, which matches Florida’s 2026 statewide schedule for these charges:

    • First-offense DUI: $500 bond. Premium: $100 (the $100 minimum applies).
    • Second-offense DUI: $750 bond. Premium: $100.
    • DUI with property damage or injury (first-degree misdemeanor): $1,000 bond. Premium: $100.
    • DUI with serious bodily injury (third-degree felony): $5,000 bond. Premium: $500.
    • DUI manslaughter: bond must be set by a judge.

Refusing the Breath Test Is Now a Crime

Since a 2025 change to Florida law, refusing a lawful breath or urine test is itself a crime. A first refusal is a second-degree misdemeanor, and a second or later refusal is a first-degree misdemeanor (Fla. Stat. 316.1939). The refusal can also be used as evidence.

Refusal also brings a longer license suspension: 1 year for a first refusal, or 18 months if the license was suspended for a refusal before.

    The 10-Day License Deadline

At the arrest, the officer takes the driver’s license and, if the driver is otherwise eligible, issues a 10-day temporary driving permit along with a notice of suspension (Fla. Stat. 322.2615).

The driver has 10 days from that notice to request a formal or informal review of the suspension with the Department of Highway Safety and Motor Vehicles. The temporary permit runs out at midnight on the 10th day. Miss the window and the suspension goes ahead: 6 months for a first offense at 0.08 or above.

    Getting Them Out

    1. Call (407) 321-2663 with their full name and date of birth. We confirm the booking, the charge and the bond.
    2. A cosigner signs the bond paperwork by phone with e-signature.
    3. You pay the premium: 10% of the bond, $100 minimum. A first-offense DUI bond of $500 costs $100.
    4. We post the bond at the Booking & Release Center.
    5. They are released once the DUI hold has cleared and the jail finishes processing.

What a DUI Conviction Can Carry

Those are the maximums in Fla. Stat. 316.193; the outcome of any case depends on its facts. For legal advice, speak with a criminal defense attorney. The Florida Bar Lawyer Referral Service can help you find one.

    • First conviction: a $500 to $1,000 fine and up to 6 months in jail.
    • Second conviction: a $1,000 to $2,000 fine and up to 9 months.
    • A third conviction within 10 years is a third-degree felony.
