If a loved one was arrested in Seminole County, you’ve probably heard the term “first appearance.” It is a short hearing held within 24 hours of every arrest, and it is often the moment a bond amount is finally set so a defendant can be released. Here is what families need to know going in.

What Is First Appearance?
First appearance (sometimes called “advisory”) is a short court hearing required by Florida law within 24 hours of an arrest. The judge confirms the defendant’s identity, reads the charges, advises them of their constitutional rights, and — most importantly for families — sets a bond amount or determines whether the defendant can be released on their own recognizance.
Where and When It Happens
In Seminole County, first appearance is typically held at the courtroom inside the John E. Polk Correctional Facility (211 Bush Blvd, Sanford). Hearings happen seven days a week, usually in the morning, including weekends and holidays.
The defendant appears by video from the jail; the judge, prosecutor, and a public defender are in the courtroom. Family members are not required to attend, but you can.
Who Attends
- The judge (a Seminole County Circuit or County judge)
- A prosecutor from the State Attorney’s Office
- A public defender (representing the defendant unless private counsel appears)
- The defendant, by video from the jail
- Family or witnesses (optional, but their presence can help the judge see community ties)
What the Judge Decides
At first appearance, the judge will:
- Read the charges and find probable cause
- Set a bond amount, lower the existing bond, or in some cases hold the defendant without bond
- Set conditions of release (no contact orders, no alcohol, GPS monitoring, etc.)
- Schedule the next court date (usually arraignment)

- Arrive 15–20 minutes early; security screening is required
- Dress neatly — you may be asked to address the judge briefly

- Don’t discuss the facts of the case with anyone in the courtroom
